Ich hab’ Kimbles Megalaunch hier ja weitgehend ignoriert, ich brauch’ diesen Deppen und seinen Budenzauber hier nicht wirklich, aber wenn sich Kimble mit der GEMA anlegt, gewinnen alle. Den Artikel auf Torrentfreak kann man weitgehend ignorieren, die Meldung kann man in drei Sätze zusammenfassen:

Ich werde da mindestens ‘nen Fuffi in den Topf tun, denn diese Leute muss man in die Schranken verweisen, denn letztlich versuchen die ihr veraltetes Geschäftsmodell über Abmahnungen auf Kosten von deutschen Bloggern zu refinanzieren.

Escape from Tomorrow: Guerilla-Movie filmed in Disneyland

Spannende Story: Randy Moore ist Filmemacher aus San Francisco und hat einen Film in Disneyland gedreht, ohne Erlaubnis und trotz mageren Equipments mit relativ hohen Production-Values. Der Film dürfte eigentlich gar nicht existieren und er wird wahrscheinlich auch nie im Kino laufen (von der Premiere beim Sundance-Festival grade mal abgesehen), weil jeder Verleih von Disney sofort in Grund und Boden geklagt werden würde. Ich schätze allerdings, dass der Film alleine wegen seiner Copyright-Fuckyou-Attitüde durch die üblichen Distributionskanäle ganz schnell online landen wird.

There is a lot of Disney iconography in the movie: Mr. Moore, a first-time director, filmed inside at least eight rides and a lengthy sequence involves the line for a Buzz Lightyear attraction.
How did Mr. Moore get away with it? After all, his cast and crew went on the It’s a Small World ride at least 12 times, filming all the way with high-tech (albeit small) video recorders. “I was surprised the ride operators weren’t a little more savvy,” he said after his movie’s premiere at the Sundance Film Festival here on Friday night.
“Escape From Tomorrow” underscores the difficulties that Disney, a company intensely vigilant about its intellectual property, faces at controlling the imagery flowing from its parks at a time when people are shooting increasing amounts of video with their smartphones. A Disney spokeswoman had no comment.
GEMA killed Space Night
So ab dem letzten Drittel meiner Feier-Glanzzeiten (circa 94 bis 98) gab’s nach einer durchgeschwitzten Nacht nichts besseres, als nach Hause zu kommen und verpeilt die Space Night auf BR3 zu schauen. Dürfte wahrscheinlich so ziemlich jedem so ergangen sein, mit Techno oder ohne und Harald Lesch verdankt seine Wissenschaftler-Popularität nicht zu einem geringen Teil zunächst einmal der Space Night.
Aber damit ist jetzt Schluß: Die GEMA hat die Space Night getötet. Ich betone es explizit nochmal an dieser Stelle: Die GEMA ist ein Kulturterrorist und hat nun auch noch eine Ikone des Nachtprogramms mit fast 20jähriger Geschichte auf dem Gewissen. Natürlich könnte der BR auf CC-Lizenzen umsteigen (wo die GEMA ja auch manchmal unter rechtlich mindestens anzuzweifelnden Bedingungen zulangt) und eine Vorher-Nachher-Kostenaufstellung würde mich auch interessieren, aber so steht es jetzt erstmal da: Die GEMA hat die Space Night getötet. Ihr Schweine!

Leider müssen wir Ihnen mitteilen, dass wir die Sendereihe “Space Night” nicht mehr im Programm von BR-Alpha führen. Grund hierfür ist, dass die GEMA eine Gebührenreform durchgeführt hat, sodass die Produktionskosten für “Space Night” für den Bayerischen Rundfunk erhöht wurden.
Daraufhin hat sich unsere Programmplanung entschieden, die Produktion der Sendereihe nicht mehr fortzusetzen.
Der BR stellt “Space Night” wegen GEMA ein

[update] Der BR arbeitet laut Metronaut an einem neuen Konzept für die Sendung, ob man dabei auch CC-Lizenzen in Betracht zieht, haben sie leider nicht beantwortet:

Fest steht, dass sich bei einer Fortführung der musikuntermalten “Space Night” die Kosten für die Ausstrahlung nach jetzigem Stand deutlich erhöhen würden. Jährlich ist von einem niedrigen siebenstelligen Betrag nur für die Musikrechte auszugehen. Diese Mehrkosten wären zu Lasten anderer Programmformate gegangen.

2011 beschloss die EU eine Schutzfristenverlängerung von 50 auf 70 Jahre, nach denen die Rechte an Werken gemeinfrei werden. Diese Fristen-Verlängerung greift allerdings nur dann, wenn die Werke innerhalb der letzten 50 Jahre veröffentlicht wurden, das heisst: Songs, die nach 1962 nicht mehr veröffentlicht wurden, sind laut dieser Regelung gemeinfrei (die Regelung greift erst ab 2014, aber prinzipiell wäre dass dann so).
Was macht man da also als Label, wenn die Arbeiten eines der bekanntesten Songwriters der Welt auf einmal in die Public Domain fallen könnten? Klare Sache, man veröffentlicht hastig schlampig zusammengestellte Compilations wie „Motown Unreleased 1962“ oder am unverschämtesten natürlich Sony mit Bob Dylans „The Copyright Extension Collection“, die hundert mal gepresst wurde und mittlerweile auf Ebay für mehr als 1000$ weggeht. Selbstverständlich alles zum Wohle des Künstlers.

There was another concern. In Europe smaller labels have been releasing recordings that have gone out of copyright as public domain compilations — so-called gray market discs — including some by Mr. Dylan. Typically, these companies have not had access to master tapes but have released material that has already appeared on bootlegs, often in superb but not master quality. Sony hopes to fight those labels with this release and any sequels.
GEMA mahnt Youtube ab
Die GEMA hat gestern mal wieder die Verhandlungen mit YT abgebrochen und praktisch zeitgleich eine Abmahnung wegen der Sperrtafeln ausgesprochen, sowie die Schiedsstelle beim Patentamt angerufen, die nun klären sollen, on die Forderung der GEMA von 0,375 Cent pro Stream angemessen ist und ob Schadensersatz wegen unlizensierter Nutzung angebracht sei. Ich halte das Wort „Kulturterroristen“ nach wie vor für eine völlig passende und angemessene Bezeichnung für beide Seiten.

First Piratebay-Server in the Museum
Das Computer Museum in Link(!)öping hat den ersten Server der Piratenbucht in seine Sammlung aufgenommen, das Teil steht natürlich in der Abteilung für „50 Years of Filesharing“.
In the first two years the hardware setup was rather primitive. The site first came online in Mexico where Gottfrid Svartholm hosted the site on a server owned by the company he was working for at the time. After a few months the site relocated to Sweden where more servers were added to keep up with the increase in traffic. One of these first servers has now been made available to the Computer Museum in Linköping where it’s now on permanent display.
The server in question is part of the “50 years of file-sharing” section and according to the museum it represents the cultural revolution that was started by the BitTorrent site.

Eine SetTop-Box, die Torrents runterladen kann und während des Downloads Filme streamt, sowohl standalone als auch über WLan/Rechner/Handy. Kostet nur 90 Euro und ist sowas von bestellt, das Teil ist wie für mich gemacht. Ich frage mich grade, ob man die Funktionalität auch auf der OUYA-Konsole hinbekommt oder auf der kommenden Steam-Box von Valve (ich bin übrigens ganz und gar nicht davon überzeugt, dass das Stückchen Xi3-Hardware, das man vor ein paar Tagen auf der CES sah, tatsächlich etwas mit der Valve-Konsole zu tun hat, sonst hätte ich da schon was zu gepostet), jedenfalls: BitTorrent Box, WANT!

Schöner Trailer zur auf dem Sundance Festival nächste Woche Premiere feiernden Doku „Google and the World Brain“. Anhand von Googles Book-Projekt schildert der Film die großen Ideen des Netzes als universeller Speicher allen Wissens der Menschheit, von Wikipedia bis Project Gutenberg, – und an welche Grenzen aus dem alten Jahrtausend diese Ideen stoßen, allen voran das Copyright. Kommen auch ein paar alte Bekannte vor, unter anderem Kevin Kelly, Larry Lessig und Clay Shirky. Der Film wurde von Arte und ZDF co-produziert, man kann also damit rechnen, dass er auch in Deutschland irgendwann zu sehen sein wird.

Heute ist Public Domain Day (außer für die USA weil wegen Copyright-Maximalism) und es gehen, wie jedes Jahr am 1. Unter anderem gehören uns ab heute die Rechte an den Arbeiten Robert Musils („Die Verwirrungen des Zöglings Törleß“) und Grant Wood („American Gothic“). The Pirate Bay is a Distributor of Culture
Gottfrid Svartholm, Mitgründer der Piratebay, sitzt derzeit im Knast in Schweden. Auf Torrentfreak schreibt nun seine Mutti über Emails an ihren Sohn und den kulturellen Wert der Bucht und von P2P im Allgemeinen – ein Argument, das mir in der Urheberrechts-Debatte viel zu unterrepräsentiert ist (da sie oft nur von Techies, Ökonomen und Verwertern geführt wird).
Many e-mails focus on access to culture in a broader sense. Young people in Saudi Arabia, for example, write that cinemas, concerts or theaters are not available to them in their own country, but that they have now received access thanks to The Pirate Bay.
From other countries, people write about how they can take part in things they would never be able to afford because of their restricted living conditions. Someone wrote that The Pirate Bay has blurred the line between the rich and the poor as to the opportunities to cultural participation. […]
I think it is about time that this perspective on The Pirate Bay gets highlighted. One must keep in mind that there is much to obtain from the site also for those who do not want to violate any copyright rules. If creators and other people representing cultural institutions want to suppress access to culture and knowledge and to free speech without considering this perspective, I think all of us are in trouble.
I, Madam, do think that, too.

TorrentFreak hat mit einer Firma für BitTorrent-Monitoring herausgefunden, dass die IP-Adressen aus den Netzen der größten Verfechter von Copyright-Maximalismus und Internetsperren selbst haufenweise Filme saugen. Das ist natürlich nix neues, aber trotzdem immer wieder sehr amüsant.

Static IP-addresses registered to Paramount were associated (e.g.) with the downloading of a wide variety of content as can be seen below. The indie production Battle Force was one of the movies shared, as well as the Lionsgate film The Hunger Games. And what about Happy Feet, a movie distributed by competitor Warner Bros?
At Warner Bros. BitTorrent is also used by many employees. Here there appears to be a particular interest in adult entertainment. The Expendables 2 is also among the titles that were downloaded via Warner Bros. IP-addresses. This is not without risk, as the makers of the movie are known to sue alleged BitTorrent downloaders.
Minecraft-Doc officially on Pirate Bay
Sehr cooler Move von den Machern der Minecraft-Doku, über die ich vor ein paar Tagen gebloggt hatte. Die haben ihre Doku selbst auf Piratebay als Torrent hochgeladen (via The Verge), da der Film früher oder später ohnehin dort landet und so können sie dort wenigstens noch ein bisschen Konversation machen.

This is 2 Player Productions here, and we hoped we could be the first to upload our new movie “Minecraft: The Story of Mojang”. We’ve never uploaded a torrent before so hopefully this isn’t all screwed up.
We wanted to come here first because we knew the movie would end up here eventually, and the best thing to do seemed to be opening a dialogue. Torrents and piracy are a way of life and it probably won’t be going anywhere anytime soon. There are many people that want to punish you for that, but we have a more realistic outlook on things.
We’ve been there. We’ve all needed to do it at some point. Maybe you don’t have the money. Maybe you want to try before you buy. Maybe you’re pissed at us for premiering the movie on Xbox Live. These are all fine reasons. But if you feel that piracy is, in Gabe Newell’s words, “a service problem,” please consider that we are selling DRM free digital downloads that you can watch in whatever manner you please.
