Instagram is selling your Pics Yadayada

Instagram behält sich in seinen neuen Terms of Service das Recht vor, alle Bilder und Metadaten für sponsored Posts innerhalb des Service zu nutzen. So weit, so langweilig, ähnlich steht das auch in den TOS von Tumblr, nur als Beispiel. Das Internet bastelt daraus grade einen Shitstorm und fantasiert Dinge wie „Instagram darf meine Bilder verkaufen“ oder sowas, und beruft sich dabei zum Beispiel auf die EFF, die etwas von „unspecified future commercial use“ erzählt.

Die „unspecified use“ ist in den TOS definiert, gleich an zwei Stellen: „To help us deliver interesting paid or sponsored content or promotions“ und „in connection with paid or sponsored content or promotions“. Natürlich ist das alles andere als ideal und einen mittelschweren Shitstorm sollte Facebook/Instagram für die Nutzung von Userbildern für Werbung durchaus abkriegen, und freilich heisst es in den TOS weiter: „you hereby grant to Instagram a non-exclusive, fully paid and royalty-free, transferable, sub-licensable, worldwide license to use the Content that you post on or through the Service“.

Aber CNets Headline „Instagram says it now has the right to sell your photos“ ist schlicht pure Panikmache und Alarmismus und auch deutsche Medien (das ZDF etwa, löbliche Ausnahme: heise) tragen diesen Bullcrap weiter und kombinieren die beiden Punkte zu irgendwelchem „Instagram-als-Bildagentur“-Nonsense, ganz davon abgesehen, das für einen solchen Bildverkauf noch ganz andere, ungeklärte Rechte tragende Rollen spielen, wie etwa das nicht unwichtige Persönlichkeitsrecht. Kleiner Tipp: Wenn solche Meldungen rumgehen, die TOS einfach mal selber lesen.

Das Internet rennt heute mal wieder im Kreis, fuchtelt mit den Armen und schreit rum. Ich bin da immer ein bisschen peinlich berührt. Erinnert sich noch jemand an „Google kills Feedburner“ vor ein paar Wochen? Chickenshit, that’s what it is.

[update] Die Updates auf heise bestätigen meine Einschätzung übrigens:

Der Abschnitt scheint sich auf die Darstellung bestimmter Nutzer-Inhalte auf Instagram bei einer Nutzer-Teilnahme an Werbeaktionen zu beschränken – ein Verkauf von Bildern durch Instagram, wie mancherorts befürchtet, ist dadurch nicht abgedeckt. Instagram hat sich zu der neuen Passage bislang nicht konkret geäußert.

[Update 18.12.2012 12:55]: In einer ersten Reaktion auf Anfragen auf Facebook erklärte Tina Kulow, Pressesprecherin von Facebook Deutschland: ‘Instagram ist nicht in dem ‘Fotoverkaufsbusiness’. Alles andere ist Spekulation.’

To be clear: it is not our intention to sell your photos. We are working on updated language in the terms to make sure this is clear.

To provide context, we envision a future where both users and brands alike may promote their photos & accounts to increase engagement and to build a more meaningful following. Let’s say a business wanted to promote their account to gain more followers and Instagram was able to feature them in some way. In order to help make a more relevant and useful promotion, it would be helpful to see which of the people you follow also follow this business. In this way, some of the data you produce — like the actions you take (eg, following the account) and your profile photo — might show up if you are following this business.
